Afghan strongman ‘raped, killed and tortured’

The head of Afghanistan's Independent Human Rights Commission has urged Hamid Karzai's government and Nato to investigate allegations that an Afghan strongman employed by United States Army Special Forces embarked on a spate of war crimes, including rape, the summary execution of children, and torture.

“We call on Special Forces — |indeed, any forces — and the Afghan government to conduct an investigation of these allegations and find out if (the allegations are) correct or not,” said Nader Nadery, who heads the Human Rights Commission.

He said the commission would make its own efforts to verify the claims against Commander Azizullah, the leader of a US-sponsored militia in the south-eastern Paktika province, but “it is a core responsibility of the government of Afghanistan to launch an investigation; this is the only way to build confidence in (the country's security) forces.”

A spokesman for Mr Karzai's office said officials had been asked to look into the allegations against Commander Azizullah.

Officials have been similarly reluctant to speak out about three photographs published on Monday showing US soldiers posing with the bodies of Afghan civilians they're alleged to have killed for sport. The images are likely to spark public outrage as they are disseminated across Afghanistan.

With an announcement yesterday by Mr Karzai that Afghan soldiers and police would take control of two provinces and four cities from Nato this summer, there may have been little desire to cloud the moment with calls for war crimes investigations.

Hague Convention of 1907, prohibits use of any “poison or poisoned weapons.

US CODE, TITLE 50, CHAPTER 40, SECTION 2302 defines a Weapon of Mass Destruction as follows:

A crime against peace, in international law, refers to “planning, preparation, initiation, or waging of wars of aggression, or a war in violation of international treaties, agreements or assurances, or participation in a common plan or conspiracy for the accomplishment of any of the foregoing”

This definition of crimes against peace was first incorporated into the Nuremberg Principles and later included in the United Nations Charter.

This definition of the crime of aggression belongs to jus cogens, which is supreme in the hierarchy of international law and, therefore, it cannot be modified by, or give way to, any rule of international law but one of the same rank.

The “territorial integrity” rule means that it is a crime of aggression to use armed force with intent permanently to deprive a state of any part or parts of its territory, not excluding territories for the foreign affairs of which it is responsible;

The “political independence” rule means that it is a crime of aggression to use armed force with intent to deprive a state of the entirety of one or more of the prerequisites of statehood, namely: defined territory, permanent population, constitutionally independent government and the means of conducting relations with other States;

The “sovereignty” rule means that it is a crime of aggression to use armed force with intent to overthrow the government of a state or to impede its freedom to act unhindered, as it sees fit, throughout its jurisdiction.

1928, the Kellogg-Briand Pact, known as the General Treaty for the Renunciation of War, said:

The High Contracting Parties solemnly declare in the names of their respective peoples that they condemn recourse to war for the solution of international controversies, and renounce it, as an instrument of national policy in their relations with one another.

The interdiction of aggressive war was confirmed and broadened by the United Nations’ Charter, which states in article 2, paragraph 4 that;
All Members shall refrain in their international relations from the threat or use of force against the territorial integrity or political independence of any state, or in any other manner inconsistent with the Purposes of the United Nations.

The U.S. Army’s Law of Land Warfare (Field Manual 27-10) states:

498. Crimes Under International Law Any person, whether a member of the armed forces or a civilian, who commits an act which constitutes a crime under international law is responsible therefore and liable to punishment.

Such offenses in connection with war comprise:
a. Crimes against peace.
b. Crimes against humanity.
c. War crimes.

The trial of Peter von Hagenbach by an ad hoc tribunal of the Holy Roman Empire in 1474, was the first “international” war crimes trial, and also of command responsibility. He was convicted and beheaded for crimes that “he as a knight was deemed to have a duty to prevent”, although he had argued that he was only “following orders”.

Legitimate authority has been abdicated by the US government by it’s brazen abandonment of the Constitution. The Constitution is the only legitimate grant of federal authority, and as it has in effect been made void by noncompliance, the authority is void as well.

BEIJING – China called Tuesday for an immediate cease-fire in Libya where the U.S. and European nations have launched punishing airstrikes to enforce a U.N. no-fly zone.

All parties must “immediately cease fire and resolve issues through peaceful means,” Foreign Ministry spokeswoman Jiang Yu said at a regularly scheduled news conference, citing unconfirmed reports that the airstrikes had caused civilian deaths.
